class=\"MsoNormal\">Members of the Faculty Bargaining Unit,<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>I&#13;<br \/>\nhave&#13;<br \/>\nexcellent news.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>You&#13;<br \/>\nmay&#13;<br \/>\nremember that in early April the FIU administration declared <b style=\"\">\u201cimpasse\u201d<\/b> in the negotiations with the&#13;<br \/>\nUFF.<span style=\"\">\u00a0 <\/span>That began a process that they&#13;<br \/>\nthought would end with the Board of Trustees unilaterally imposing a&#13;<br \/>\nnew&#13;<br \/>\nbargaining agreement on the faculty, one with all of the <b style=\"\">rights&#13;<br \/>\nand protections<\/b> of the previous agreement removed to <b style=\"\">university&#13;<br \/>\npolicy<\/b> only, where they&#13;<br \/>\ncould not be enforced by the <b style=\"\">grievance&#13;<br \/>\nand arbitration<\/b> procedure.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>In&#13;<br \/>\nMay the&#13;<br \/>\nUFF filed an <b style=\"\">Unfair Labor Practice<\/b>&#13;<br \/>\ncharge against FIU, on the grounds that by forcing the impasse they&#13;<br \/>\nhave&#13;<br \/>\ndeprived us of our right to bargain the rights and protections in the&#13;<br \/>\n17&#13;<br \/>\narticles of the previous agreement that they intend to leave \u201cvacant\u201d.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>At&#13;<br \/>\nthe same&#13;<br \/>\ntime we filed a <b style=\"\">Motion to Stay the&#13;<br \/>\nImpasse<\/b>.<span style=\"\">\u00a0 <\/span>We argued to the Public&#13;<br \/>\nEmployees Relations Commission (PERC) that there was no point in going&#13;<br \/>\nahead&#13;<br \/>\nwith the impasse proceedings, because if we won the Unfair Labor&#13;<br \/>\nPractice, PERC&#13;<br \/>\nwould order both sides back to the bargaining table and instruct the&#13;<br \/>\nadministration to bargain those rights and protections.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Last&#13;<br \/>\nWednesday, June 15, <b style=\"\">PERC granted our Motion&#13;<br \/>\nto Stay the Impasse<\/b>.<span style=\"\">\u00a0 <\/span>The effect of&#13;<br \/>\nthis is two-fold.<span style=\"\">\u00a0 <\/span><b style=\"\">First<\/b>, the&#13;<br \/>\nimpasse process will now be on hold until PERC can rule&#13;<br \/>\non the Unfair Labor Practice charge.<span style=\"\">\u00a0 <\/span>Our&#13;<br \/>\nattorneys think that the arguments will not be heard until probably&#13;<br \/>\nwell into&#13;<br \/>\nJuly, and that a decision will probably not come down until September&#13;<br \/>\nor&#13;<br \/>\nOctober at the earliest.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Whatever&#13;<br \/>\nthe decision then, <b style=\"\">the status quo<\/b>&#13;<br \/>\nbased on the previous bargaining agreement <b style=\"\">will&#13;<br \/>\nnow be in place well into the middle of the fall <\/b>semester, and&#13;<br \/>\nprobably&#13;<br \/>\nlonger.<span style=\"\">\u00a0 <\/span>This will prevent the Board of Trustees&#13;<br \/>\nfrom imposing their extreme solution for a non-existent problem for a&#13;<br \/>\nlengthy&#13;<br \/>\nperiod.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>In&#13;<br \/>\nthe&#13;<br \/>\nunlikely event we lose the Unfair Labor Practice, the impasse procedure&#13;<br \/>\nwill&#13;<br \/>\nbegin again, probably in mid-fall, with a public hearing at which both&#13;<br \/>\nsides&#13;<br \/>\npresent their arguments.<span style=\"\">\u00a0 <\/span>Then the&#13;<br \/>\nSpecial Master will offer his suggested agreement in a public meeting.<span style=\"\">\u00a0 <\/span>Then the Board of Trustees would propose an&#13;<br \/>\nagreement that must be submitted to the bargaining unit for a&#13;<br \/>\nratification&#13;<br \/>\nvote.<span style=\"\">\u00a0 <\/span>Once it is rejected\u2014and if it is&#13;<br \/>\nanything like the current proposal it will be rejected&#13;<br \/>\noverwhelmingly\u2014the Board&#13;<br \/>\ncould impose an agreement on us, but only for that fiscal year, with&#13;<br \/>\nbargaining&#13;<br \/>\nbeginning again for the next year.<span style=\"\">\u00a0 <\/span><b style=\"\">This&#13;<br \/>\nprocess will probably put us well into&#13;<br \/>\nthe second semester, perhaps later.<\/b> <\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><b style=\"\">Second<\/b>, however, our attorneys believe&#13;<br \/>\nthat the Motion to Stay the Impasse would not have been approved unless&#13;<br \/>\nPERC thought&#13;<br \/>\nthat our Unfair Labor Practice charge had merit.<span style=\"\">\u00a0 <\/span>So&#13;<br \/>\nwhile we should not break out the bubbly&#13;<br \/>\njust yet, we are optimistic that PERC will follow the law and its own&#13;<br \/>\nprecedents and rule that the strategy the administration has been&#13;<br \/>\nfollowing is&#13;<br \/>\nillegal, as we have argued from the beginning.<span style=\"\">\u00a0&#13;<br \/>\n<\/span><b style=\"\">Both sides would then return to&#13;<br \/>\nthe table<\/b>, with the administration charged to abandon its previous&#13;<br \/>\napproach&#13;<br \/>\nand to bargain in good faith.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><b style=\"\">The time is ripe for the administration to&#13;<br \/>\ncome to its senses<\/b>, start with the previous state-wide bargaining&#13;<br \/>\nagreement&#13;<br \/>\nthat worked well for 27 years, change the handful of things that need&#13;<br \/>\nto be changed,&#13;<br \/>\nand reach agreement with the faculty.<span style=\"\">\u00a0 <\/span>(USF,&#13;<br \/>\nFAU, UCF, FGCU, and <place><placename>New<\/placename><placetype>College<\/placetype><\/place>&#13;<br \/>\nhave already done this.<span style=\"\">\u00a0 <\/span>No other&#13;<br \/>\nadministration is still following the FIU approach.)<span style=\"\">\u00a0 <\/span>We&#13;<br \/>\ncould finish by the end of the&#13;<br \/>\nsummer.<span style=\"\">\u00a0 <\/span>Then FIU could return to normal&#13;<br \/>\nand we could all get on with the business of educating students and&#13;<br \/>\ncreating&#13;<br \/>\nknowledge.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Or,&#13;<br \/>\nthe&#13;<br \/>\nadministration could continue this unnecessary attack on its own&#13;<br \/>\nfaculty,&#13;<br \/>\ncontinue to demoralize the university, and continue to drive away many&#13;<br \/>\nof its&#13;<br \/>\nbest faculty.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Just&#13;<br \/>\nin&#13;<br \/>\ncase the administration chooses to continue down its destructive path, <b style=\"\">we have plans to build our strength<\/b> so&#13;<br \/>\nthat we will be in a position to ultimately prevail, no matter how long&#13;<br \/>\nit&#13;<br \/>\ntakes.<span style=\"\">\u00a0 <\/span><b style=\"\">First<\/b>, that means <b style=\"\">continuing&#13;<br \/>\nto build up the membership of UFF<\/b> so that no one can doubt that UFF&#13;<br \/>\nspeaks&#13;<br \/>\nfor the faculty and so we can bring to bear the resources needed to win.<span style=\"\">\u00a0 <\/span>We are very close to having a majority of the&#13;<br \/>\nbargaining unit as members, so we will be campaigning to go over the&#13;<br \/>\ntop.<span style=\"\">\u00a0 <\/span>If you have not yet joined UFF, a&#13;<br \/>\nmembership&#13;<br \/>\nform may be downloaded at <a href=\"http:\/\/www.uff-fiu.org\/nindex.php\/uff.form.html\">http:\/\/www.uff-fiu.org\/nindex.php\/uff.form.html<\/a><\/p>\n<p\/>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><b style=\"\">Second<\/b>, we will build our strength by <b style=\"\">reaching&#13;<br \/>\nout to our natural allies<\/b>.<span style=\"\">\u00a0 <\/span>Some of them are&#13;<br \/>\non campus, like our <b style=\"\">co-workers<\/b> in USPS (secretarial&#13;<br \/>\nstaff,&#13;<br \/>\nmaintenance workers, etc) who are represented by AFSCME, nurses&#13;<br \/>\nrepresented by&#13;<br \/>\nSEIU, and the police represented by PBA, who are facing the same&#13;<br \/>\ndemands that&#13;<br \/>\nwe are\u2014that they give up their rights and protections that have been&#13;<br \/>\nenforceable by grievance and arbitration.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>I will have more to report about this below.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0 Other&#13;<br \/>\nallies on campus include the <b style=\"\">students<\/b>.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>They have an interest in keeping the best&#13;<br \/>\nfaculty and researchers from being driven away by attacks from the&#13;<br \/>\nadministration.<span style=\"\">\u00a0 <\/span>The articles in the&#13;<br \/>\nBeacon, Herald, and Sun-Sentinel have motivated many students to&#13;<br \/>\napproach&#13;<br \/>\nfaculty about what is going on here.<span style=\"\">\u00a0 <\/span>We&#13;<br \/>\nwill continue to encourage such inquisitiveness\u2014outside of the&#13;<br \/>\nclassroom, of&#13;<br \/>\ncourse.<span style=\"\">\u00a0 <\/span>(It is illegal in this state to&#13;<br \/>\nuse class time to build support for a faculty union.)<span style=\"\">\u00a0 <\/span><span style=\"\">\u00a0<\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Many&#13;<br \/>\nof our&#13;<br \/>\nnatural allies are off campus, and we are beginning to reach out to&#13;<br \/>\nthem.<span style=\"\">\u00a0 <\/span><b style=\"\">FIU&#13;<br \/>\nalumni<\/b> have an interest in keeping the best faculty here, and we&#13;<br \/>\nare&#13;<br \/>\nconfident many will respond to a call to save FIU\u2014and the value of&#13;<br \/>\ntheir&#13;<br \/>\ndegrees\u2014from the extremists who would impose a corporate model on the&#13;<br \/>\nuniversity.<span style=\"\">\u00a0 <\/span>Many of us in the faculty&#13;<br \/>\nkeep in touch with former students, and some have already asked how&#13;<br \/>\nthey can&#13;<br \/>\nhelp us.<span style=\"\">\u00a0 <\/span>We will help them come together&#13;<br \/>\nto aid us in our efforts.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The&#13;<br \/>\nbroader&#13;<br \/>\n<b style=\"\">organizations with which UFF is&#13;<br \/>\naffiliated<\/b>\u2014the American Federation of Teachers (<b style=\"\">AFT<\/b>),&#13;<br \/>\nthe National Education Association (<b style=\"\">NEA<\/b>), and the&#13;<br \/>\nFlorida Education Association (<b style=\"\">FEA<\/b>)\u2014are already&#13;<br \/>\nfollowing our efforts closely and supporting&#13;<br \/>\nthem.<span style=\"\">\u00a0 <\/span>We are not the only university&#13;<br \/>\nconfronted with outsiders trying to impose a corporate model of&#13;<br \/>\ngovernance,&#13;<br \/>\nrather than the collegial governance model we have been used to.<span style=\"\">\u00a0 <\/span>Because the leaderships of these broad&#13;<br \/>\norganizations like the way we have stood up to the attacks on us, they&#13;<br \/>\nhave let&#13;<br \/>\nus know that they are eager to step up their support in any way they&#13;<br \/>\ncan.<span style=\"\">\u00a0 <\/span>We will be happy to accept their increased&#13;<br \/>\nassistance.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>There&#13;<br \/>\nare many&#13;<br \/>\nin the local community who have a strong interest in restoring a&#13;<br \/>\nhealthy&#13;<br \/>\nFIU.<span style=\"\">\u00a0 <\/span>The UFF has worked with many <b style=\"\">labor&#13;<br \/>\nand community organizations<\/b> over&#13;<br \/>\nthe years, as well as with <b>local political leaders<\/b>, and many&#13;<br \/>\nwill respond to a&#13;<br \/>\ncall to save FIU from those who have an ideological agenda to pursue.<span style=\"\">\u00a0 <\/span>We are reaching out to them and look forward&#13;<br \/>\nto the creative ways we know they will come up with to aid our efforts.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Let&#13;<br \/>\nme turn&#13;<br \/>\nnow to <b style=\"\">the attack on our secretaries and&#13;<br \/>\nother USPS workers<\/b> on campus. <span style=\"\">\u00a0<\/span>You&#13;<br \/>\nmay have seen the email sent out by Vice President Vivian Sanchez, the&#13;<br \/>\nnew head&#13;<br \/>\nof Human Resources.<span style=\"\">\u00a0 <\/span>In it she outlined&#13;<br \/>\nthe salary offer the administration has put on the bargaining table in&#13;<br \/>\nnegotiations with AFSCME, which represents USPS workers.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>The offer is a <b style=\"\">$750 raise or 2%, whichever is&#13;<br \/>\ngreater, plus 1% merit pay<\/b>.<span style=\"\">\u00a0 <\/span><\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>This&#13;<br \/>\noffer&#13;<br \/>\nis better than it appears since most USPS employees are paid so little&#13;<br \/>\nthat&#13;<br \/>\n$750 is 3%, or 4%, or even more of their current salaries.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>$750 is 3% of $25,000 for example; it is 4%&#13;<br \/>\nof $18,750, and many USPS employees make less than that.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>Can you imagine trying to live in <place>South Florida<\/place>&#13;<br \/>\non that?<span style=\"\">\u00a0 <\/span>It is&#13;<br \/>\nshameful.<span style=\"\">\u00a0 <\/span>To its credit, AFSCME demanded&#13;<br \/>\nthat most of the increase be a fixed amount across the board to address&#13;<br \/>\nthe&#13;<br \/>\nneeds of their least-paid workers.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>What&#13;<br \/>\nMs.&#13;<br \/>\nSanchez did not address in her email, is <b style=\"\">the&#13;<br \/>\nrest of the story<\/b>.<span style=\"\">\u00a0 <\/span>The&#13;<br \/>\nadministration has taken the same approach to the <b style=\"\">rights&#13;<br \/>\nand protections enforced by grievance and arbitration<\/b> in the&#13;<br \/>\nprevious AFSCME bargaining agreement that they have taken with UFF\u2014we&#13;<br \/>\nwill put it in&#13;<br \/>\nuniversity policy and you can trust us to be fair.<span style=\"\">\u00a0 <\/span>Naturally,&#13;<br \/>\nthe AFSCME bargaining team has no&#13;<br \/>\nintention of accepting.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Further,&#13;<br \/>\nthe administration\u2019s proposal would <b style=\"\">change&#13;<br \/>\nthe status of USPS employees to \u201cat will\u201d<\/b>.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>The AFSCME bargaining agreement allows the university to&#13;<br \/>\nterminate&#13;<br \/>\nemployees only for \u201cjust cause\u201d\u2014misconduct and incompetence\u2014enforced by&#13;<br \/>\nthe&#13;<br \/>\ngrievance procedure which can end before a neutral, third-party&#13;<br \/>\narbitrator.<span style=\"\">\u00a0 <\/span>Now the university wants the right&#13;<br \/>\nto&#13;<br \/>\nterminate \u201cwithout cause\u201d, to have the employees serve at the will of&#13;<br \/>\ntheir&#13;<br \/>\nsupervisors.<span style=\"\">\u00a0 <\/span>The administration calls&#13;<br \/>\nthis a 21<sup>st<\/sup> Century Human Resources approach.<span style=\"\">\u00a0&#13;<br \/>\n<\/span>Apparently they are looking forward to the 21<sup>st<\/sup>&#13;<br \/>\ncentury being a lot like the 19<sup>th<\/sup> century of the robber&#13;<br \/>\nbarons.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>Finally,&#13;<br \/>\nthe administration\u2019s offer is <b style=\"\">take-it-or-leave-it<\/b>:<span style=\"\">\u00a0 <\/span>To get the $750, AFSCME has to agree to waive&#13;<br \/>\ntheir rights and protections, their grievance and arbitration process,&#13;<br \/>\nand&#13;<br \/>\ntheir right to termination only if the administration can prove just&#13;<br \/>\ncause, or&#13;<br \/>\nelse the administration will remove the salary offer after June 30.<span style=\"\">\u00a0 <\/span>The administration figured that USPS workers&#13;<br \/>\nare so impoverished that they will demand the money and give up the&#13;<br \/>\nrights they&#13;<br \/>\nhave had for years.<\/p>\n<p>&#13;<\/p>\n<p class=\"MsoNormal\">\n<p>\u00a0<\/p>\n<p><span style=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>The&#13;<br \/>\nAFSCME&#13;<br \/>\nleadership called a meeting last Thursday so that the bargaining team&#13;<br \/>\ncould get&#13;<br \/>\nguidance from the bargaining unit.<span style=\"\">\u00a0 <\/span>The&#13;<br \/>\nroom was packed with the biggest turnout anyone could remember, with&#13;<br \/>\nmore&#13;<br \/>\nparticipating by teleconferencing on the BBC campus.<span style=\"\">\u00a0 <\/span>After&#13;<br \/>\nfull discussion a straw vote was taken&#13;<br \/>\nand the vote was <b
